The amount a landlord can charge a tenant for a security deposit depends solely on the length of the lease term.

If the length of the lease is week to week, the security deposit cannot exceed the amount of two weeks’ rent.

If the length of the lease is month to month, the security deposit cannot exceed the amount of one and one-half month’s rent.

If the length of the lease is greater than month to month, the security deposit cannot exceed one and one-half month’s rent.

The applicable North Carolina statute that addresses security deposit amounts for North Carolina landlords is NC General Statutes § 42-51-(b).
